Further, upon the effective date of COGCC Rule 604.c.(2), as adopted by the COGCC on February 11, 2013, Applicant agrees to utilize the mitigation measures set forth in Rule 604.c.(2) in Designated Setback Locations in accordance with the terms of such rule."
