"The Parties recognize that a portion of the Field is within the Fort Collins City Limits and as such, development has occurred within the already established Field. The surface owner has obtained permitted plats for residential areas in the vicinity of existing oil and gas activities, including a constructed city park and contemplated building units and public roads within three hundred fifty (350) feet of an existing well. Further, the Parties acknowledge that the Commission rules require a minimum of five hundred (500) feet safety setback for New Well construction from a building unit and one thousand feet (1,000) from a high occupancy building." pg. 8
