"2.3 Use of Existing Infrastructure: . . .At the request of the County, Black Hills shall furnish information demonstrating Black Hills's requested need for new facilities (roads, pipeline easements, well pads, etc.) and new facilities may be required due to:
a. The lack of existing infrastructure m a COGCC permitted Fruitland drilling window.
b. Engineering, geologic, safety, surface feature, economic, and/or without limitation any other constraints that make use of existing infrastructure reasonably impractical.
c. Facility ownership constraints that make the sharing or use of existing facilities reasonably impractical." |
