In this appellate decision, the Colorado Supreme Court held that Fort Collin's five-year moratorium on fracking and the storage of fracking waste within the city is preempted by state law and is, therefore, invalid and unenforceable. The court concluded that the matters were of mixed state and local concern and operationally conflicted with the effectuation of state law. |
